The term "Portal" is understood to mean, but is not limited to, the texts, graphics, images, animations, musical creations, videos, sounds, drawings, photographs, etc. included in the Portal and, in general, all such creations expressed in any medium or on any support, tangible or intangible, currently known or as may be invented in the future, regardless of whether they are susceptible or not of being considered intellectual property in accordance with the Revised Text of the Intellectual Property Act or any such body of law as may replace it in the future. The term "User" is understood to be anyone accessing the Portal. Users may use the services and contents exclusively for individual and private purposes, and may not make subsequent use of any contents for profit-making purposes or for any personal benefit, either direct or indirect, except for those which are strictly permitted. D) COMPANY DIRECTORY TERMS OF USE The exclusive owner of the present Directory is the PORT AUTHORITY OF VALENCIA (hereinafter PAV) and it is protected by operating and sui generis rights of the Revised Text of the Intellectual Property Act and for the effects of said regulation, the PAV is the exclusive owner of the rights of reproduction, distribution, public communication and transformation as well as the rights of extraction, permanent or provisional transfer of the totality or any substantial part of the Directory, of the reutilisation of same and all manner of making available to the public the totality or any substantial part of its contents by means of distribution of copies in the form of sales or any other transfer of its property or by rental, online transmission and any other form of same. The undertaking of any action indicated in this paragraph shall require the express written authorisation of the PAV. Similarly, it is forbidden for the user of the Portal to undertake actions contrary to current legislation, such as the extraction and/or reutilisation of the totality or any substantial part of the contents of the Directory, and the extraction and/or repeated or systematic reutilisation of non-substantial parts of the contents of the Directory whenever they should involve actions that are contrary to normal use of the same and may conceivably cause unjustified damages to the legitimate interests of the PAV. The PAV warns the user that the present Directory may only be used for private purposes and as a tool for consulting and contacting companies in the trade by extracting and/or reutilisation of non-substantial parts of its contents. It shall be forbidden to use any data for undertaking advertising activities, irrespective of the kind of advertising vehicle used, with the user being considered the sole responsible party for undertaking any actions whatsoever contrary to current legislation with respect to data protection (LOPD) and information society services (LSSICE). E) STOPOVER SYSTEM TERM OF USE The exclusive owner of the present database is the PORT AUTHORITY OF VALENCIA (hereinafter PAV) and it is protected by operating and sui generis rights as granted under the Revised Text of the Intellectual Property Act and for the effects of said regulation, the PAV is the exclusive owner of the rights of reproduction, distribution, public communication and transformation as well as the rights of extraction, permanent or provisional transfer of the totality or any substantial part of the database, of the reutilisation of same and all manner of making available to the public the totality or any substantial part of its contents by means of distribution of copies in the form of sales or any other transfer of its property or by rental, online transmission and any other form of same. The undertaking of any action indicated in this paragraph shall require the express written authorisation of the PAV. F) RIGHTS AND OBLIGATIONS OF THE USER The user may: - Freely access without any need for prior authorisation the contents and services of the Portal available as such, without prejudice to the technical or particular conditions or the need for prior registration with respect to the services and specific contents, as set forth under these general conditions or in the Particular Conditions of said services. - Use the services and contents available exclusively for private use, without prejudice to the dispositions of the particular conditions that regulate the use of a given service and/or contents. The user may also download one single copy of the web page for visualisation "off-line" for personal but not for commercial reasons. - Make proper and lawful use of the website in accordance with current legislation, morality, good customs and public order. H) PAV DISCLAIMER - The PAV disclaims all responsibility for any such damages as may occur in the following cases: - For any difficulties involved in connecting to the communications network through which this Portal is supposed to be accessible, or for the total impossibility of connecting, irrespective of the kind of connection device employed by the user. - For the interruption, suspension or cancellation of access to the Portal, as well as the operational availability and continuity of the Portal or of the services and/or contents of the same for reasons which are beyond the control of the PAV irrespective of whether the causes for same can be attributed either directly or indirectly to the PAV. J) HYPERLINKS Persons or bodies intending to make or making hyperlinks from one website on Internet to the website or pages thereof of the Valenciaport Portal shall be subject to the following conditions: - The reproduction in whole or in part of the services and/or contents of the Portal is forbidden. - No deep links, or IMG or image links or frames using the Portal pages shall be permitted without the express prior authorisation of the PAV. - No false, inexact or incorrect statements shall be included concerning the pages of the Portal or any of the services or contents thereof. - Save those elements forming part of the “hyperlink”, the web page on which it is placed shall contain no brand image, trademark, trade name, proprietary lettering, denomination, logo, slogan or any other distinctive mark of the PAV except as expressly authorised by the PAV. - Making a "hyperlink" in no way implies the existence of any type of relationship between PAV and the proprietor of the website or portal where such a link is made. - The PAV shall in no way be responsible for the contents or services made available to the public on the web page or portal where such a “hyperlink” is made, nor for the information, statements or any other material included on such pages or portals. - Any "hyperlink" to the Valenciaport Portal shall be made to its home page or the main page of the sections contained therein K) ) LINKS The PAV accepts no responsibility for the information contained on web pages pertaining to third parties connected via hyperlinks with the Valenciaport Portal, nor on any websites managed directly by the PAV Portal administrator. J) PERSONAL DATA PROTECTION In order to use some of the services appearing on this Portal, users are first required to provide certain data of a personal nature to the PAV. N) COMPLETE AGREEMENT These general conditions contain the complete conditions agreed upon by the parties in relation to the purpose of said conditions and no other previously accorded conditions, commitments, verbal, written or tacit promises or statements in respect thereof shall be considered to be valid. The fact that any of the parties involved should not at any point in time demand or require the fulfilment of any of the conditions established under these general conditions, or as the case may be, of any of the particular conditions regulating the use of a given service and/or content intended for Portal users, shall not be interpreted by the other party as a waiver of any right to demand or require fulfilment in the future. O) ANNULMENT AND NULLIBILITY Should a given clause of these general conditions, or as the case may be, of the particular conditions regulating the use of the given service and/or content, be annulled or considered void, in whole or in part, such annulment or nullibility shall not affect the validity of any other clauses contained herein, which shall remain fully effective and valid, except where the party alleging nullibility or voidability can satisfactorily prove that without the clause considered to be voidable or annullable the purpose of the present conditions can no longer be fulfilled. P) GOVERNING LAW AND JURISDICTION The parties hereto hereby expressly renounce the jurisdiction of other courts that may correspond to them, and accept to be governed under the present general conditions by Spanish Law and by the resolution of any disputes related thereto at the courts and tribunals of the city of Valencia, Spain. PAV PRIVACY POLICY AUTORIDAD PORTUARIA DE VALENCIA (hereinafter PAV - Port Authority of Valencia), with offices at Muelle de la Aduana, s/n, 46024 VALENCIA, Spain, is concerned to inform users of this website of its policy with respect to the processing and protection of user data of a personal nature that the PAV retrieves from users when they visualise the Portal or use any of the services provided thereon. Data of a personal nature are understood to be sequences of numeric, alphabetical, graphic, photographic, acoustic or any other kind of information relating to identified or identifiable physical persons. The retrieval of personal data, and their subsequent processing and use, are subject to current legislation in Spain on data protection set forth in Organic Law 15/1999 of 13 December on Protection of Data of a Personal Nature (hereinafter LOPD) and its byelaws. The PAV shall only be responsible for and guarantee the confidentiality and security of data of a personal nature retrieved from users of the Portal, and in no cases shall accept responsibility for subsequent processing and use of personal data that may be made by third parties providing information society services acting outside the bounds of the Valenciaport Portal. When are data of a personal nature retrieved from users of the Portal? Data of a personal nature may initially be retrieved when a user fills out any of the subscription forms for periodical bulletins, publications or news services provided by the PAV through the Portal; when a user sends an electronic mail to the PAV using any of the e-mail addresses placed on the Portal, or when any of the registration forms enabling files or applications offered by the PAV for downloading from the Portal are completed by the user, provided the PAV is identified as the responsible party for the data retrieved in such a way. If you do not want the PAV to process your personal data, you are asked to refrain from completing the forms provided on the Portal. In all cases, the PAV will expressly and legibly provide you with information on the conditions under which your personal data are retrieved and the purpose from which they will be used, and of the prerequisite of supplying such data or not, and the rights you enjoy as a user, of the conditions under which may exercise such rights, and of any other additional information that may be required. Personal data processing is understood to be any operation or technical procedure, of an automated character or otherwise, that enables data to be retrieved, recorded, stored, elaborated, modified, blocked and/or cancelled, and data to be transferred or placed at the disposal of others as a result of communications, consultations, interconnections and information transfers. Purpose of the retrieval and processing of personal data With respect to personal data retrieved by means of e-mail and/or the completion of forms placed on the Portal, the purpose of processing shall be that corresponding to the request made by the user, and may be any of the following: processing a subscription being ordered, delivering by e-mail a publication or bulletin being ordered, maintaining a register of registered users, allowing access to file or application downloads as requested, and in general attending to and answering comments, suggestions or questions made by users. Data communication to the PAV shall be true and valid and up-to-date. Should the user be under age or incapacitated, the PAV reminds users of the need to obtain the prior consent of parents or guardians or legal representatives for any communications of personal data, in which cases the PAV asks users to refrain from using the e-mail service and/or registration forms if no such consent is forthcoming from parents, guardians or legal representatives. In no cases shall the PAV be responsible for the actions or consequences of use by a minor or incapacitated person Rights enjoyed by users with respect to their personal data Users may at any time be informed of the data which have been retrieved and processed by the PAV with respect to their persons; modify such information if it is inexact; cancel such data or discontinue its processing, with the only limit in this latter case being those cases in which it is not necessary to have the user's consent for processing his or her data, as long as not otherwise stipulated by law, and when there are well-founded and legitimate reasons with respect to a given personal situation, or when personal data processing is effected for advertising or commercially prospective purposes. To exercise these rights the user is required to address a written communication, together with a photocopy of his or her National Identity Card or any other valid and legal means of identification to accredit his or her identity, to the following address: Autoridad Portuaria de Valencia, Muelle de la Aduana, s/n, 46024 VALENCIA, Spain, or to that address which may at any time replace it as registered with the Spanish Data Protection General Registry (Registro General de Protección de Datos). This written communication must contain the following information: - Names and surname of the user. - Identification of the request being made. - Address to be used for notifications, date and signature of user. - Documents accrediting the request being made, if necessary. The PAV hereby informs users that the exercise of these rights is entirely personal, meaning that only the user him or herself may exercise said rights with respect to his or her respective personal data. Nevertheless, in cases of legal representation, the authorised representative of the user may exercise any such rights as may be permitted with respect to personal data protection provided such a request is accompanied by an accredited document indicating that such representation actually exists. The PAV hereby informs that the exercise of said rights by a third party who is not legally authorised by the user may involve the perpetration of the criminal offence of disclosure and revealing of secrets as set forth in Paragraph Two of Section 197 of the Spanish Criminal Code, penalised with prison sentences of one to four years and fines of twelve to twenty-four months, without prejudice to any other consequences which may be forthcoming as a result of any civil or administrative procedures that both the legitimate possessor of the personal data and the PAV may have a right to exercise. Should a user order a subscription to any of the bulletins or publications or news services offered by the PAV through the Portal asking the PAV to e-mail the bulletin or publication requested, the PAV hereby informs such users that they may revoke at any time their consent by requesting cancellation of their subscription by using the corresponding subscription form on the Portal, or by sending an e-mail to webmaster@valenciaport.com requesting unsubscription, in which case the data supplied by the user will be cancelled by the PAV. Cookies Description: Cookies are tools used by web servers to store and retrieve information on web visitors. They are simple text files that some servers ask a user's browser to write onto the user's hard disk containing information about what the user has been doing on the web server's pages. Cookies used by the Valenciaport Portal: The PAV uses cookies to facilitate browsing on its Portal and to achieve greater efficiency and personalisation of the services offered to users. The cookies used on valenciaport.com are only associated with a given computer; they do not provide references enabling the names or surnames of users to be deduced, and they cannot read data on the user's hard disk or include viruses in texts. Similarly, valenciaport.com cannot read cookies placed on the user's hard disk by other servers. The cookies used on valenciaport.com are always of the permanent kind: Permanent Cookies: these cookies have a long expiry period, and remain in storage on the user's computer long after the browsing session has finished. The Permanent Cookies used on valenciaport.com have the following purpose: they store information on the user's language preferences so that contents can be provided in accordance with such a preference each time the user accesses the Portal. The user may freely decide whether or not to allow cookies from valenciaport.com to be placed on his or her hard disk. The PAV reminds users that Internet is not always as secure as society would wish, and that the necessary technical measures should be taken to avoid unauthorised processing of your personal data. The PAV warns users that whenever they provide personal information over the Internet using e-mails, newsgroups, chats, etc. they should remember that such information may be retrieved and processed for purposes that users may not agree with, and for this reason the PAV recommends users always to read the information on the confidentiality and privacy policies of the websites that they visit online. The PAV warns users to always bear in mind that, except when encrypting devices are used, e-mail via the Internet is not secure. You should always bear in mind that messages sent by electronic mail and chat sessions may be intercepted and used by third parties to impersonate you.
