Port fees, as stipulated under section 14 of Act 48/2003, are levied for the private use or special exploitation of the public domain of Spanish ports and for the rendering of non-commercial services by Spanish Port Authorities.

The regulations governing port fees are contained in Act 48/2003 of 26 November 2003, BOE (Official State Gazette) No. 284 of 27 November 2003, and in any such matters as not contained therein, in the Act of Public Fees and Prices (Ley de Tarifas y Precios Públicos), the general tax laws and regulatory standards established during the development of such acts and laws.

Such fees are classified as follows:

a) For the private utilisation or special exploitation of public domain territory in ports, as follows: 

Fee for privately occupying the public domain in ports.

-          Section 19 of Act 48/2003 contemplates diverse legal aspects required for the elaboration of this fee, and in paragraph 1º states that “the occupation of the public domain in ports, by virtue of concessions or authorisation, shall be subject to a fee in favour of the Port Authority”.

Fee for the special exploitation of port installations. This fee includes the concepts as listed below:

Vessel fee

Sporting and recreational vessel fee

Fare fee

Goods fee

Fresh fish fee

Fee for the special exploitation of the public domain in the exercise of commercial, industrial and services activities.

-          Section 28 of Act 48/2003 contemplates diverse legal aspects required for the elaboration of this fee, and in paragraph 1º states that “the rendering by third parties of services and the exercise of commercial, industrial or other activities of a similar or dissimilar nature within port zones shall be subject to authorisation or licencing, which shall accrue a corresponding fee in favour of the Port Authority”.

b) For the rendering of non-commercial services by Port Authorities. This type of fee includes the following:

Maritime signalling services fee

-          Section 26 of Act 48/2003 contemplates that each Port Authority shall annually apply an identical correction coefficient to the amount of its Vessel, Fare and Goods Fees, depending on the profitability of its operations. This coefficient, intended among other purposes to strengthen the competitiveness of ports, was established for the year 2008 by the Board of Directors of Valencia Port Authority in the annual meeting held on 17 December 2007 at 0.965. This reduction in cost of the Vessel, Fare and Goods Fees has been applied to the total amounts indicated below in the individual explanation of each Fee.
